1. Introduction

Welcome to the BIZMONI™ Associate Program! By joining, you agree to comply with the following terms and conditions. These terms are designed to ensure a fair and transparent relationship between BIZMONI™ and our associates.

2. Definitions

Associate: An individual or entity approved by BIZMONI™ to promote its services and products.

Customer: Individuals or entities that purchase or sign up for BIZMONI™'s products through an Associate's referral.

Associate Link: A unique tracking link provided to Associates used for referrals.

Commission: The payment Associates earn for successful referrals that convert into sales.

Referral: A potential customer who visits the BIZMONI™ website via an Associate's Associate Link.

Associate Program: The program managed by BIZMONI™ that enables Associates to promote products and earn commissions.

3. Participation Requirements

To join the BIZMONI™ Associate Program, you must:

Be at least 18 years old and have a functioning website or social media platform.

Complete the application process, providing necessary details such as your full name and website URL.

Agree to these terms and conditions.

Associates are expected to:

Maintain up-to-date information about BIZMONI™'s offerings on their platforms and ensure the content is accurate and ethical.

Promote BIZMONI™ products ethically and professionally, adhering to legal standards and best practices.

Use only true, complete, and accurate information in their promotions to ensure compliance with applicable laws, including advertising and privacy regulations.

4. Commission Structure

Standard Commission Rate: Associates can earn a 10-20% commission on each sale generated through their referral link, depending on the specific product or service offered by BIZMONI™.

Lifetime Commission: Commissions may continue as long as the referred customer remains a paying user. This incentivizes Associates to attract high-quality, long-term customers.

Conditions for Adjustments: Commissions may be withheld or adjusted if fraudulent activities are detected or if the Associate engages in prohibited activities as defined in this agreement. BIZMONI™ reserves the right to suspend or terminate the Associate’s account if there are breaches of the terms, including any violation of the Code of Conduct or ethical standards outlined by BIZMONI™.

5. Payment Channels

Available Payment Options:

PayPal: Payments will be processed securely through PayPal, offering global accessibility. Associates must ensure their PayPal accounts are valid and up-to-date to avoid payment delays.

Stripe: A secure platform for processing payments that provides additional financial protections and fraud prevention measures.

Direct Bank Transfer: For associates preferring direct payments into their bank accounts. Associates must provide accurate bank details, and BIZMONI™ is not liable for any errors arising from incorrect information.

Transaction Fees:

Associates are responsible for any transaction fees incurred during the payment process unless otherwise stated in writing by BIZMONI™.

BIZMONI™ reserves the right to deduct any transaction fees from the commissions before processing payments to the Associates.

Associates must acknowledge that payment processing is conducted through third-party services; hence, BIZMONI™ shall not be held liable for any delays, errors, or discrepancies arising from these third-party services.

6. Payment Schedule

Monthly Payouts: Payments are processed on the 15th of each month for commissions accrued in the previous month.

Buffer Period: A 45-day buffer period post-transaction is applied to account for potential returns, chargebacks, and disputes. During this period, BIZMONI™ reserves the right to review transactions for legitimacy and compliance with program guidelines.

If a transaction is found to be fraudulent or invalid during this review, BIZMONI™ may revoke the associated commission and adjust future payments accordingly.

BIZMONI™ is not liable for any delays in payment due to unforeseen circumstances related to transaction review or processing.

Minimum Payout Threshold:

Associates must reach a minimum of $250 in earnings before a payout is issued. This threshold is designed to ensure efficient transaction processing and to mitigate administrative costs associated with smaller payments.

BIZMONI™ reserves the right to amend this threshold at its discretion, with notice provided to associates in advance. Any changes will apply to future payouts only and will not affect previously earned commissions.

Payments may be delayed or withheld if the Associate’s account is under review for compliance with program terms or if there are irregularities in transaction activity.

7. Allowed Promotions

Associates are encouraged to share their unique links via social media, blogs, and email newsletters, following BIZMONI™'s brand guidelines and terms of service.

All promotional materials will be provided through the Associate dashboard, and these materials must be used as-is without alteration, to maintain brand integrity and compliance.

Associates must ensure that all communications with potential customers are clear, truthful, and not misleading, and must not exaggerate the benefits of BIZMONI™’s products.

BIZMONI™ reserves the right to review and approve any marketing materials that Associates plan to use and can require modifications or retract approvals at its discretion.

8. Prohibited Activities

Associates are prohibited from:

Bidding on BIZMONI™ brand keywords in paid search campaigns, including but not limited to the use of misspellings or variations of the brand name, unless explicitly authorized in writing by BIZMONI™.

Engaging in any deceptive advertising practices or disseminating misleading information about BIZMONI™ or its products that could damage BIZMONI™’s reputation or mislead potential customers.

Conducting activities that may harm BIZMONI™’s reputation, including the promotion of illegal, harmful, or unethical content.

Self-referring or referring immediate family members, which will automatically negate any earned commissions and could lead to account suspension.

Other Restrictions:

Associates must not engage in any activities that violate applicable laws, including spam laws (e.g., CAN-SPAM Act, GDPR), and must comply with established ethical marketing practices. Any violation will result in immediate termination from the program and forfeiture of any pending commissions.

BIZMONI™ reserves the right to evaluate marketing activities and to suspend or terminate the Associate's access to the program if any prohibited activities are detected.

Legal Defence By participating in the BIZMONI™ Associate Program, Associates agree to indemnify and hold BIZMONI™ harmless from any claims, damages, or expenses (including legal fees) that arise from their violation of these provisions.

9. Data Privacy and GDPR Compliance

BIZMONI™ is committed to protecting the privacy of its Associates and Customers. All personal data collected in the course of this program will be processed in accordance with applicable data protection laws, including GDPR.

Associates must ensure that any personal data they collect, process, or share in relation to the program complies with GDPR requirements. This includes obtaining consent for data collection and ensuring the secure handling of personal data.

BIZMONI™ will only collect and process personal data necessary for the administration of the Associate Program.

10. Legal Compliance

Associates must comply with all applicable laws and regulations, including but not limited to the General Data Protection Regulation (GDPR) and Federal Trade Commission (FTC) guidelines. This compliance should encompass:

Ethical marketing practices, including obtaining consent for communications and clearly disclosing any partnership when promoting BIZMONI™ products.

Adherence to local laws regarding privacy, advertising, and consumer protection.

BIZMONI™ may require documentation or proof of compliance at any time, and failure to provide such documentation can result in immediate termination from the program.

11. Updating Terms

BIZMONI™ reserves the right to update these terms at any time to reflect changes in legal requirements, business practices, or operational improvements. Such updates will be communicated to Associates via email or through the Associate dashboard.

Associates will be notified of any changes at least 30 days in advance of the changes taking effect. By continuing to participate in the program after the changes are announced, Associates agree to be bound by the updated terms.

If any Associate disagrees with the new terms, they may terminate their participation in the program without penalty, provided they notify BIZMONI™ within the notice period.

12. Termination Clause

BIZMONI™ reserves the right to terminate any Associate account that violates these terms and conditions at its discretion, with or without prior notice. This includes, but is not limited to, cases involving: Fraudulent activities, including self-referrals or manipulation of referral systems. Abuse of the Associate program, including the dissemination of false information or deceptive marketing practices. Repeated non-compliance with program guidelines or legal requirements.

In the event that an account is terminated by the Associate for any reason, unpaid commissions above the minimum threshold will be paid out, provided that the Associate complies with the guidelines and conditions stipulated in this agreement up to the point of termination.

13. Limitation of Liability

BIZMONI™ provides no warranty or guarantee regarding the Associate Program, its availability, or the accuracy of any tracking systems. The program is provided on an "as-is" and "as-available" basis.

BIZMONI™ is not liable for any direct, indirect, consequential, or special damages arising from participation in the Associate Program or any reliance on the materials or information provided therein. This includes, but is not limited to: Loss of profits, revenue, or business opportunities. Costs incurred as a result of reliance on the Associate Program.

BIZMONI™’s aggregate liability in connection with the Associate Program shall not exceed the total commissions earned by the Associate in the six months prior to the event giving rise to the claim.

Associates acknowledge that they have read and understood these terms and voluntarily agreed to participate, accepting all associated risks and limitations of liability.

14. Support and Communication

A dedicated support channel is available for Associates to resolve any payment or program-related issues. Associates can contact BIZMONI™’s support team via email or through the designated support portal. Response times may vary depending on the volume of inquiries.

BIZMONI™ will provide regular updates and newsletters to keep Associates informed of any changes, policy updates, or new promotional opportunities. However, it is the responsibility of Associates to stay informed by regularly checking the Associate dashboard and their registered email for pertinent information.

BIZMONI™ is not liable for any losses or damages arising from an Associate's failure to receive communications due to incorrect contact information or failure to regularly monitor updates.

Support provided will be at the discretion of BIZMONI™, and Associates acknowledge that the support team may not address inquiries regarding terminated accounts or violations of the terms.

15. Acceptance

By participating in the BIZMONI™ Associate Program, you acknowledge that you have read, understood, and agree to abide by these terms and conditions. Your participation constitutes a binding agreement between you and BIZMONI™.

BIZMONI™ reserves the right to modify these terms and other program policies at any time, and continued participation will be deemed acceptance of any changes. By continuing in the program, you agree to remain compliant with the updated terms.

If you do not agree to any of the terms or conditions, you must opt out of the BIZMONI™ Associate Program immediately. Failure to do so may result in repercussions as outlined in the termination clause.
